Biometric Data Consent & Retention Policy
How Loadgency handles the identity data used to verify carriers and drivers — and your rights over it. Effective ______________, 2026.

Who this applies to. This policy covers carriers and drivers who complete identity verification or a pickup check-in on Loadgency. If you are a shipper posting a vehicle to move, this does not apply to you — we do not collect biometric data from shippers.

1. Why we verify identity

Auto-transport fraud — double-brokering, carrier impersonation, and cargo theft — depends on one thing: someone claiming a load who isn't who they say. To protect shippers, drivers, and honest carriers, Loadgency verifies that the person claiming and picking up a load is the real, authorized carrier. Part of that verification uses biometric data.

2. What biometric data we collect

When you complete identity verification or a pickup check-in, we (through our identity-verification vendor) may collect and process:

Under the Illinois Biometric Information Privacy Act (BIPA) and similar laws, a “scan of face geometry” is a “biometric identifier,” and data derived from it is “biometric information.” We treat all of the above as biometric data governed by this policy.

3. Purpose — and only this purpose

Your biometric data is collected and used only to: (a) confirm your identity when you onboard or verify your carrier account; (b) confirm at pickup that the driver present is the same verified person who claimed the load; and (c) prevent fraud, impersonation, and theft. We do not use it for marketing, advertising, tracking, or any purpose beyond identity verification and fraud prevention.

4. How it is processed and secured

Biometric verification is performed by a third-party identity-verification provider (for example, a KYC/identity vendor). That provider processes the facial match and ID check. Any biometric data is transmitted and stored using encryption and access controls at least as protective as how we protect other confidential information. We limit access to personnel and systems with a need to know for verification and fraud prevention.

5. We never sell your biometric data

We do not sell, lease, trade, or otherwise profit from your biometric identifiers or biometric information. We do not disclose it except: (a) to our identity-verification provider to perform the verification; (b) as you direct or authorize; (c) as required to complete a transaction you requested; or (d) as required by law, warrant, or subpoena.

6. Retention and destruction schedule

We keep biometric data only as long as needed for the purpose above, and we permanently destroy it on the earliest of:

We maintain a written retention-and-destruction schedule and follow it. Verification results (e.g., “identity verified: yes/no,” the date) may be retained longer as a business and compliance record, but the underlying biometric identifiers are destroyed on the schedule above.

7. Your consent is required and voluntary

We will collect your biometric data only after you give informed, written consent (the acknowledgment below or its in-app equivalent). Consent is voluntary. You may decline — but because identity verification is how we keep the network safe, declining may mean you cannot complete verification or claim loads that require it. You may withdraw consent at any time (Section 8).

8. Your rights

You may, at any time, contact us to: request confirmation of what biometric data we hold; request its deletion; or withdraw your consent going forward. Email privacy@loadgency.com. We will respond within the timeframes required by applicable law. Withdrawing consent or requesting deletion may end your ability to use identity-gated features.

9. State-specific notice

Residents of states with biometric-privacy laws have specific rights, and this policy is written to honor them:
